Conditions of sale

Please read hereby conditions of sale

The owner of e-store https://mynobsi.com (hereinafter Webstore) is Treeni Minuga OÜ, registry code 14588385, address Harju street 29, Aruküla, 75201 Estonia.

The validity of the contract of sale, product and price information

Conditions of sale are valid when buying products from the Webstore. Prices of the products that are on sale on Webstore are marked near the products. Purchases in Estonia are not subject to additional delivery costs. When ordering products to Europe, the delivery fees will be covered by the buyer and relevant product information is displayed around the mode of delivery.

The delivery fee depends on the location of the customer and the method of delivery. The delivery fee will be displayed for the customer when processing the order. Information about the product is presented in Webstore near the product. Prices and billing on Webstore will be done in EUR currency.

Payment for the products on Webstore can be paid with:

  • Bank link
  • Invoice
  • Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay

Kiigesellid OÜ is a responsible personal data processor. Kiigesellid OÜ transfers relevant personal data for processing the payment to authorized processor Maksekeskus AS.

Processing an order

The selected products must be added to the shopping cart in order to make an order.

In order to process the order, all required data fields need to be completed and a suitable delivery method should be selected. Then the total amount will be displayed on the screen, which can be paid via bank link or other payment solution.

The contract takes effect from the moment the payable amount is credited to the Webstore bank account.
If the ordered product can’t be shipped because the stocks have run out or for any other reasons, then the customer will be notified in the first opportunity and the paid amount will be returned (including delivery fees) without delay but no later than within 14 days of receiving the notification.

Delivery

Products will be sent to the following countries:

  • Estonia – 2 – 5 working days
  • Europe – 3 – 7 working days
  • Rest of the world – ask us for a quote

The delivery fees of the products ordered in Estonia will be covered by the supplier. When ordering the products in Europe, the buyer will pay for the delivery fees and the relevant price information is displayed next to the delivery method.

Delivery partners are:

  • TNT Express Worldide Eesti AS (registry code 10393756)
  • VENIPAK EESTI OÜ (registry code 12142751)

Delivery will be done with a courier. The courier will get in touch with the Customer using the telephone number marked in the order, in order to agree the exact time for delivery. Goods will be delivered to the address set by the customer.

In general, the deliveries within Estonia will reach the destination set by the buyer within 2-5 working days from the moment the sales contract comes to force.

The delivery outside Estonia will take place within 3-7 calendar days depending on the destination.

In exceptional cases, the delivery of the product can take place within 14 calendar days.

Right of withdrawal

After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 30 days.

(Depending on the product, the purchaser may not necessarily have the right of withdrawal; in such a case the corresponding products and services must be listed and they must comply with the conditions provided for in subsection 53(4) in the Law of Obligations Act.)

The right of withdrawal does not apply if the purchaser is a legal person.

To exercise the 30-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store.

If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

To return the goods, you must submit a declaration of withdrawal (the form for which can be found here: declaration of withdrawal) to the e-mail address within 14 days of receiving the goods.

The purchaser shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).

The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

Upon receiving the returned goods, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract.

The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.If the buyer has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.

The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the marketprice of the goods due to an error.

Making a complaint

Webstore is responsible for not meeting the sold product contract conditions or flaws of the product that existed already at the moment of handing over the item and that appears within two years from the moment the product has been handed over to the buyer. When the item has been handed within six months then it will be presumed that the fault existed already at the time of handing it over.

It is the responsibility of the Webstore to challenge the respective presumption.

If a fault appears, the buyer has the right to turn to the Webstore at least within two months by sending an email to info@gmynobsi.com or by calling on 003725187825.

If the product that was bought on Webstore has faults that belong under Webstore responsibility, then the Webstore will repair or replace the faulty product.

If the product cannot be repaired or replaced then the Webstore will return all the fees related to the sales contract to the buyer. The Webstore responds to the complaint made by the consumer in writing or in a method that allows reproducing within 15 days.

Direct marketing and processing personal data

The Webstore uses the personal data entered by the buyer (including name, phone number, address, email address, bank account details) only for processing the order and sending the products to the buyer. The Webstore will transfer personal data to a delivery service provider only for delivering the goods.

Webstore sends newsletters and offers only if the buyer has expressed clear interest by entering their email address in the website and expressed their interest for receiving direct marketing messages. The buyer has the right to unsubscribe from email offers and newsletters at any time by sending us a notification through email or by following the instructions in the email newsletter.

Settling a dispute

If the buyer has any complaints towards the Webstore then they should be sent to email address kiigesellid@gmail.com or by calling us on 003725187825.

If the buyer and Webstore are not able to settle the dispute in an agreement then the buyer can turn to Commission of Consumer Disputes. You can familiarize yourself with the procedural conditions and submit an application here. The Commission of Consumer Disputes has the jurisdiction to solve any disputes that relate to the contract signed between the buyer and the Webstore. The buyer complaint review by the Commission is free of charge. The buyer can turn to the European Union’s platform of consumer dispute resolutions.

CUSTOM ORDERS

When making a customer order, the terms and sale conditions are changeable due to the agreement between the client and Treeni Minuga OÜ and these are confirmed in writing between both parties. Products made under custom order are not returnable unless the product does not meet the usual quality, agreed conditions or agreed requirements.
